All individuals and businesses involved in the handling, transportation, storage, and trade of molasses must be registered and licensed by the Sugar Directorate. This process ensures that all molasses-related activities comply with the regulatory standards set to maintain quality and safety within the industry.

Key Guidelines for Registration and Licensing:

  1. Licensing and Registration:

    • All molasses dealers, including importers and exporters, are required to be licensed and registered with the Sugar Directorate. This registration ensures compliance with the regulations outlined in The Crops (Sugar) (Import, Exports and By-products) Regulations, 2020.
    • The registration and licensing process may involve an inspection of production facilities, transportation, and storage facilities to ensure they meet regulatory standards.
  2. Molasses Sales:

    • Millers are required to sell molasses exclusively to valid procurement permit holders on a first-come, first-served basis. Sales must adhere to the approved quantities, as recommended by the miller and determined by the Sugar Directorate.
    • The procurement permits specify monthly procurement quantities based on the Directorate's guidelines.
  3. Fees for Export Permits:

    • Procurement permits for exporting molasses will incur fees at double the rates charged for local procurement, emphasizing the higher regulatory oversight for exports.
  4. Application Submission:

    • Applications for molasses permits must be submitted online through the Agriculture and Food Authority’s Integrated Management Information System (AFA-IMIS) portal at www.imis.afa.go.ke.

Requirements for Service:

  • For Farmers:

    • Copy of Farmer’s Identification Card: Proof of identity for farmers applying for molasses permits.
    • Filled Molasses Permit Application Form: This form must be completed and endorsed by the local administration and livestock office to validate the farmer's need for molasses.
  • For Distillers, Distributors, Processors, and Animal Feed Manufacturers:

    • Company KRA PIN: A valid Personal Identification Number from the Kenya Revenue Authority for the company.
    • Tax Compliance Certificate: Proof that the company is up-to-date with its tax obligations.
    • Certificate of Incorporation: A document that proves the company is legally registered and recognized as a corporate entity.
    • CR-12: A document that lists the directors and shareholders of the company.
    • County Business Permit: A permit from the local county government authorizing the business to operate within the jurisdiction.
    • Valid Alcoholic Drinks NACADA License: Required for businesses involved in alcoholic drinks, this license is issued by the National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA).
    • Commitment Letter by a Miller Supplying Molasses: A letter from a miller confirming their commitment to supplying molasses to the applicant.

Fees:

  • Local Molasses Procurement Permit Fees:
    • Annual Charges:
      • KSh. 500 per tonne for quantities up to 10 tonnes.
      • KSh. 300 per tonne for quantities above 10 tonnes, up to a maximum fee of KSh. 400,000 for molasses procured on a monthly basis.
