To legally repackage sugar in Kenya, businesses must obtain a Sugar Repackaging Certificate from the AFA-Sugar Directorate. This certificate ensures that the repackaged sugar meets the required standards and complies with all regulatory requirements.

Trademark Registration Certificate:
- A valid Trademark Registration Certificate is required to confirm that the brand under which the sugar will be repackaged is legally protected. This certificate ensures that the brand is registered and recognized by the relevant authorities.

Sample of the Brand:
- A physical or digital sample of the brand design and packaging must be provided. This sample is reviewed to ensure that it meets the required labeling standards and does not mislead consumers.

Certificate of Incorporation or Certificate of Registration:
- The Certificate of Incorporation is needed for companies, while a Certificate of Registration is required for other types of business entities. This document verifies that the business is legally established and recognized in Kenya.

Valid Business Permit:
- A valid business permit issued by the relevant county government is necessary to confirm that the business has permission to operate within the jurisdiction. This permit ensures that the business complies with local regulations.

Valid KRA Tax Compliance Certificate:
- A Tax Compliance Certificate from the Kenya Revenue Authority (KRA) is required to demonstrate that the business is up-to-date with its tax obligations. This certificate ensures that the business is financially responsible and adheres to tax regulations.

Directors’ ID or Passport:
- Copies of the national identity cards or passports of the company directors must be provided. These documents are used to verify the identities of the individuals responsible for the business operations.

Approval from KEBS:
- Approval from the Kenya Bureau of Standards (KEBS) is required to ensure that the repackaged sugar meets the quality and safety standards set by the national standards body. This approval is crucial for maintaining public health and safety.
Application Process:
- Submission: Applications for the Sugar Repackaging Certificate are submitted online through the Agriculture and Food Authority’s Integrated Management Information System (AFA-IMIS) portal at www.imis.afa.go.ke.
- Review: The AFA-Sugar Directorate reviews the submitted documents to verify compliance with all regulatory and safety requirements. This includes checking the trademark registration, business credentials, and KEBS approval.
- Approval and Issuance: If all requirements are met, the AFA-Sugar Directorate issues the Sugar Repackaging Certificate, authorizing the business to legally repackage sugar under the specified brand.
