Step 1 - Registration/Letter of Comfort to Establish a Jaggery or Mill
To establish a sugar mill or jaggery production facility, applicants must first obtain a Letter of Comfort from the Sugar Directorate, which grants initial approval to proceed with their project. This letter is essential for starting the establishment process and ensures compliance with all regulatory requirements.
Requirements for Service:

Certificate of Incorporation:
- This document is issued by the Registrar of Companies and verifies that the business entity is legally registered and recognized as a corporate body. It must be provided to demonstrate the legal status of the entity applying for the establishment of the mill or jaggery facility.

Form CR 12:
- Form CR 12 is an official document from the Registrar of Companies that provides information about the company’s directors and shareholders. This form helps verify the identity and legitimacy of the people behind the business.

KRA PIN Certificate:
- A Personal Identification Number (PIN) issued by the Kenya Revenue Authority (KRA) is required to ensure the company is registered for tax purposes. The KRA PIN Certificate links the business to the tax system, ensuring compliance with all tax regulations.

Valid Environmental Impact Assessment (EIA) License:
- An EIA License, obtained from the National Environment Management Authority (NEMA), is mandatory. This license confirms that the proposed project has undergone an environmental impact assessment and that appropriate measures are in place to mitigate any negative environmental effects.

Letter of No-Objection from Respective County Government(s):
- The applicant must secure a letter from the local county government indicating no objection to the proposed establishment. This letter ensures that the project aligns with local zoning laws, regulations, and community standards.

Proof of Land Ownership:
- Evidence of land ownership is required, which can be in the form of a Land Title Deed or a Lease Agreement. This proof is necessary to ensure that the applicant has the legal right to use the land for the proposed project.

Project Feasibility Study Report/Project Profile:
- A comprehensive report that assesses the technical and financial feasibility of the project. This report should include market analysis, projected costs, potential revenues, and a risk assessment to demonstrate the project’s viability and sustainability.

Facility Site Plan and Layout Plan:
- Detailed drawings and plans of the proposed facility’s site and layout must be provided. These plans should illustrate the physical layout of the mill or jaggery production facility, including the placement of machinery, storage areas, and safety measures.

Demonstration of Cane Availability and Cane Development Plan:
- Applicants must provide evidence of sufficient cane supply for the proposed facility’s operations. This includes a cane development plan outlining strategies for sustainable cane sourcing, cultivation, and supply chain management.
Application Process:
- Submission: Applications are submitted online through the Agriculture and Food Authority’s Integrated Management Information System (AFA-IMIS) portal at www.imis.afa.go.ke.
- Review and Site Inspection: After submission, the Sugar Directorate will review the application and schedule a site inspection to verify compliance with the requirements and assess the feasibility of the proposed project.
- Gazettement Period: The application undergoes a 30-day public gazettement period during which the project is announced to the public to allow for any objections or comments.
- Issuance of Letter of Comfort: If the application is successful and no substantial objections are raised during the gazettement period, a Letter of Comfort will be issued, allowing the applicant to proceed with the establishment of the mill or jaggery production facility.
Cost of Service: The service is provided at no cost.
Timeline: The entire process, including the gazettement period, is expected to take up to 60 days.
Note: Any extension to this process is not gazetted, meaning it will not be formally announced in the Kenya Gazette.
